LABOR REGULATIONS IN JAPAN


Very brief summary about the Japanese labor regulations are as follows:

Recruitment

 

No Gender (Age?) Discrimination

Labor Contract

 

@ duration of employment, A work location and job description

B work hours, C wages, D retirement.

Wages

 

More than minimum, At least once a month

Work Hours

 

Legal work hours: 8 hours a day, 40 hours a week

 

Break (45 min for 6 hours/1 hour for 8 hours)

At least one rest day per week

   To have employee work more than legal work hours

     

- Submit 36 Agreement to Labor Standard Inspection Office

- Pay Increased wages for overtime work (+25%), work on rest days (+35%) and night work (+25%)

Modified work hour systems

 

Monthly/annual/flexible working hours-averaging systems

Deemed work hour systems

 

Out of the site/discretional working hour systems

Exclusions for Legal Work Hours

 

Persons in positions of supervision or management or handling confidential matters

Retirement age

 

Mandatory: no less than 60 years old

Desirable: no less than 65 years old

Sexual Harassment

 

No sexual harassment allowed

Termination/Dismissal

 

- Shall provide at least 30 days advance notice or 30 days pay

 

- Dismissal without fair reasons is invalid

Child care /Family care Leave

 

Shall grant it for employee meeting certain conditions

Health & Safety

Medical examination before employment and once a year

Rule of Employment

    Shall create and submit it to Labor Standard Inspection Office if more than 9 employees
