Finding that the state and the city were not in compliance with state law, he ordered them to provide emergency shelter for homeless men immediately in consideration of the weather. Attorneys for the state and the city were stunned. Plaintiffs had requested seven hundred and fifty beds; the city, caught short, asked that the number be left flexible. Plaintiffs willingly agreed. Hayes knew that city officials had no idea how many homeless men there actually were. Soon, more than a thousand men were seeking shelter every night, and the city had to scramble to keep up. The judge’s ruling was of small use to Robert Callahan, however. He was found dead of alcoholism on a street near the Bowery not long afterward.
